Personal Accident Claims Procedures

Claim Forms

  1. All claim forms to clearly show name of Insured and which particular state association they are part of.
  2. Claim forms to note:
    • Confirmation of “Gross Weekly Earnings” substantiated by employer, and/or “Statement of operations” for harness earnings. You may be asked to supply taxation returns/assessments to substantiate income.
    • All supporting documentation is attached I.E. medical certificates, Non–Medicare receipts, Out of Pocket expenses.
    • If applicable “Medical Practitioner’s Statement to be completed by appropriate treating doctor.
    • “Medical Authority, Declaration” to be signed by claimant.
    • Copy of Insured’s current licence.
    • Private Medical benefit Fund details if applicable.
    • This policy does not pay Medicare related expenses or the Medicare gap.
    • If you have a Private Medical Fund you should seek reimbursement from the health fund prior to claiming from this policy.

Claims Lodgement

  1. All Claims to be lodged directly to Corporate Services Network (CSN) either via facsimile, e-mail with scanned documents or mailing to the following contacts:

  2. Upon receipt of claim form and within 5–10 working days, CSN will provide a return e-mail notifying licensee insurance co-ordinator of claim lodgement and either:
    • Claim acceptance and advice on when settlement can be expected, inclusive of settlement calculation rationale, or;
    • Request for additional information.

Claims Settlement

  1. All Non–Medicare Expense claims will be assessed in accordance with policy terms & conditions. Appropriate supporting documentation will be required. Upon acceptance, the applicable excess of AU$50.00 will be deducted. Maximum benefit AU$5,000.00
  2. Calculation of “Income Protection” settlements will be based on 85% up to maximum AU$600.00 of “Gross Weekly Earnings” substantiated in writing from employer. Weekly benefits payable up to a maximum period of 104 weeks. The “Excess Period” (Non-Payment/Deferral period) represents 7 days and is calculated from the commencement date of injury and will be reduced by any amounts payable through Workers comp, sick leave or from any other accident compensation type scheme (you must be able to provide medical evidence of date of injury).
  3. Any claims to be declined entirely will be advised to the claimant, with reasons for the declinature. Appropriate Internal Dispute Resolution (IDR) procedures will also be provided in accordance with the Insurer’s compliance with the General Insurance Code of Practice.

Important Notes

Please note: The medical expense cover provided by this policy relates to “Non-Medicare Medical Expenses” only. Any medical expenses attracting Medicare benefits will not fall within the scope of this cover.

Please retain a copy of all documentation submitted to Insurers.

Claims Notification

It is very important that, as soon as you become aware of circumstances which could give rise to a claim against you, you must forward a written note of the circumstances to your State Controlling Body. This is the case even if a claim has not yet been made against you. Your State Controlling Body will forward an incident report form to you for completion.

You must forward any claim/demand from a third party to your State Controlling Body immediately, together with any additional facts known to you. Do not make any admission of liability or promises to the claimant, or enter into any correspondence with them without the written consent of your Insurers.

When your State Controlling Body receives your notification of the claim, the matter will then be referred to JLT for appropriate action.

Please note that claims may take time to resolve due to the investigation and litigation processes involved.

IMPORTANT: It is extremely important not to admit liability, offer to make any payments or discuss the matter with any claimant or potential claimant.
